| 内容記述 | The “Infectious Diseases Control Law (Act on Prevention of Infectious Diseases and Medical Care for Patients with Infectious Diseases)” was enforced on April 1 , 1999 instead of the “Infectious Disease Prevention Law” (enforced in 1897 ). It is said that infectious disease countermeasures are currently taken in harmony between various measures to prevent infectious diseases and consideration for the human rights of patients. The “Infectious Diseases Control Law” was revised on October 16 , 2003 (and enforced on November 5 ), and was revised again on April 1 , 2007 to be integrated with the “Tuberculosis Prevention Law”. It was further revised on May 2 , 2008 in preparation for the spread of highly pathogenic avian influenza (H 5 N 1 ) and the outbreak and spread of new influenza. “Pandemic Influenza (Novel Influenza or Re-emerging Influenza)” has been added in addition to the seven classifications of the five types of infectious diseases of categories 1 to 5 , and designated infectious diseases, and new infectious diseases. The revised “Infectious Diseases Control Law” was enforced on February 13 , 2021 , putting new coronavirus infections into “Pandemic Influenza (Novel Influenza or Re-emerging Influenza)” from the “designated infectious diseases”. The preamble to this “Infectious Diseases Control Law” states the following. Mankind has over time experienced hardship due to various diseases, including infectious diseases. The spread of plagues, smallpox, cholera and other infectious diseases has often plunged human civilization into a state of crisis. The eradication of infectious diseases has in particular been a long-sought after goal of mankind. Meanwhile, in the past in Japan there was groundless discrimination or prejudice against patients suffering from leprosy, acquired immunodeficiency syndrome (AIDS), and other infectious diseases, and those suffering from similar illness. The Japanese public must take these facts seriously and apply them as a moral lesson for the future. When considering measures against infectious diseases in Japan, it is very important to understand that there were two major missteps (big mistakes) in the history from the Meiji era, as mentioned in the above sentence. That's the problem of “leprosy” and “HIV-tainted blood products”. In the above sentence, it is described as a problem of “groundless discrimination or prejudice”, but the essential problem seems to be the failure of the administrative and governing policies of the Japanese government that promoted the discrimination and prejudice. The composition of“policy failure”, which is the essence of this problem, is not only the cause of the failure of the administration in the past, but also the current composition that still remains today in Japan. In this paper we will examine the issues of institutional governance in Japanese government regarding “medical and public health administration” that can be seen from the problem of Hansen’s disease in Japan. |
