| 内容記述 | This paper examines the extent to which the effectiveness of TPNW can be ensured in the current situation in which nuclear weapon states do not become parties to the treaty in the foreseeable future, by examining some issues in the interpretation of the positive obligations stipulated in Articles 5-7 of the Treaty on the Prohibition of Nuclear Weapons (TPNW) and analyzing national implementation of these obligations. Looking at the implementation of the obligations under Article 5 by some leading TPNW state parties, in terms of the prohibition of the use of nuclear weapons, the use of nuclear weapons is criminalized, directly or indirectly, in all of the states. In addition, in some countries, the criminal statutes apply extraterritorially. This will contribute to some extent to the effectiveness of the TPNW. In addition, the fact that the use of nuclear weapons is indirectly criminalized in some countries that are both state parties to the TPNW and members of the ICC may have an impact on the interpretation of the ICC Statute. The proper functioning of the framework of “shared responsibility” in Articles 6 and 7 of the TPNW through the practices by States Parties in the future will be a touchstone for its effectiveness as a treaty. The fact that TPNW is a human rights treaty means that, from a practical point of view, it can be discussed in international human rights bodies such as the Human Rights Council of the United Nations, and there is a possibility that it will be taken up as an issue in these bodies in the future. This will also contribute to increasing the effectiveness of TPNW on victim assistance and environmental restoration. |
