内容記述 The current overt threats by one country to use nuclear weapons have pointed to the most critical security environment since the Cold War. On the other hand, attention has been focused on the issue of assistance to victims of the use and testing of nuclear weapons, and some Korean hibakusha are calling for redress for their own harm and for responsibility for the atomic bombings. This paper will begin with a brief description of the actual situation of Korean Hibakusha, which provides the background for this movement. Then, the paper examines the starting point for the Korean Hibakusha in their quest for legal responsibility for the U.S. atomic bombings of Hiroshima and Nagasaki in 1945, namely, how the atomic bombings were evaluated in light of the (customary) international law of the time. This review will mean a reexamination of the Shimoda Case Judgment. Finally, some future issues will be summarized.
Tens of thousands of people from the Korean Peninsula were exposed to the atomic bombings in Hiroshima and Nagasaki under Japanese colonial rule. In Japan, certain relief measures are provided for Korean A-bomb survivors under the Atomic Bomb Survivors’ Support Law. In South Korea, a certain amount of assistance is also provided under the Special Act on Support for Korean Atomic Bomb Victims, but the relief for Korean Hibakusha is not sufficient compared to the current situation for Japanese Hibakusha.
The atomic bombings of Hiroshima and Nagasaki were illegal in light of customary international law at the time of 1945, particularly the principle of distinction regarding military objectives and the principle of prohibition of unnecessary suffering. This is the same conclusion as the 1963 Shimoda Case Judgment.
Today, however, 60 years after this judgment, there are new issues to be addressed, as follows. First, the significance of the Martens Clause must be examined. Second, the issue of the rights and remedies of Korean Hibakusha remains unresolved. Finally, the issue of the responsibility of states that have used nuclear weapons is being newly questioned within the international community. It is necessary to examine these issues in the future.
