| 内容記述 | When we consider how the concept of "religion" or the recognition of the relationship between "state and religion" was constructed and penetrated in postwar Japanese society, the accumulation of lawsuits related to the separation of state and religion is a field of special importance. This paper examines the Tsu-Jichinsai lawsuit (filed in 1965), which questioned whether it violated the Constitution for a local government to sponsor a Shinto-style Jichinsai (groundbreaking ceremony) and to expend public funds for it. This case became an important precedent as the first decision on the separation of state and religion by the Supreme Court in postwar Japan, and also attracted a great deal of attention from both society and constitutional studies, as it provided an important criterion of "purpose-effect standard". This paper analyzed, from the perspective of the sociology of religion, the background of the lawsuit, the course of it, and the aftermath of the decision. As a result, the study clarified that this case arose as the Yasukuni Shrine issue became a social problem and was joined with this issue, that multiple concepts and perspectives on "religion", "customs", or "state and religion" were observed in the trial, and that the judicial decision had a practical impact on various groups and areas. |
