| 内容記述 | This paper primarily provides a legal assessment of the current use of nuclear weapons since 1945 in light of the Genocide Convention and the International Criminal Court (ICC) Statute. Under the Genocide Convention and the ICC Statute, some, but not all, uses of nuclear weapons may constitute the crime of genocide, crimes against humanity, or war crimes. In addition, individual criminal responsibility may be pursued for state leaders who decide to use them. However, there are some points to note. First, there are certain limitations to the exercise of the ICC's jurisdiction. Second, there is the issue of the "reservations" made by France and the UK to the ICC Statute. Third, the Genocide Convention allows disputes under the Convention to be unilaterally referred to the ICJ. However, the Convention can be withdrawn from. As the possibility of litigation based on the Convention increases, the likelihood of targeted states withdrawing from the Convention may increase. |
