A law scheme is also proposed to support this sector in its advocacy function. This theme is important because the actualization of public welfare has been thought to be the exclusive domain of the government in Japan. Yet this tends to made people be estranged from the process. Furthermore, public welfare via the government is often influenced by the interests of financial circles or the government itself. Therefore, Japanese society requires a new concept for public welfare which the nonprofit sector can offer. The law scheme proposed for the nonprofit sector supports the sector in its advocacy function not only in respect of incorporation systems but also regarding taxation--particularly the taxation of individual charitable contributions.\n\\n　1998年3月25日、特定非営利活動促進法(NPO法)が公布された。この法律によって、民間の非営利組織が法人格を取得する道は格段に広くなったと評価されている。\n　この立法の推進力になったのは、阪神・淡路大震災に際して被災者救援のために、全国から多数のボランティアが結集し、行政をしのぐほどの活動を展開したことである。したがって、NPO法の目的が、弱者救済のためのいわゆるボランティア活動支援にあると一般に考えられるのも無理はない。\n　しかし、NPOは、いわゆるボランティア活動(社会サービスの私人による無償の提供と一般にイメージされるところのもの)を行う団体にとどまるものではない。NPO活動の本質は、これまで国や地方公共団体(中央集権化した行政国家においては、特に中央官庁)の独占物と考えられてきた「公共」「公益」(の実現)という機能を、市民が直接に分有することにある。\n　伊藤裕夫は、以下のように述べる。「NPOの社会的な機能を一般化するならば、まず第一に、NPOは身近な地域社会や関心分野に何らかの問題なりニーズを発見し、それをいわば当事者の視点から、それらを解決したり充たしたりしようと考える、社会的ニ一ズの発掘者である。第二に、そうした社会的ニーズの充足を行政や企業に要求したり委ねるのではなく、まず自分たちでできる範囲で、その解決・充足に即応的、先駆的に立ち向かう、社会サービスの供給主体である。第三に、社会サービスを担う中で、課題の背景や関連する問題を明確にしつつ、これらの問題を社会に提起し課題の共有化を図るとともに、その解決のための資源の提供を社会に呼びかける「アドボケート(唱道者・代弁者)」である。そして第四に、そうして得た社会からの資源を、自身の活動の生産性と質的向上のために活用し、活動の継続と拡大をはかるイノベーター(革新者)である。個々のNPOはこれら四つの機能はすべて合わせもっているわけではないが、NPO全体としては、社会に働きかけてニーズを発掘し、それを自ら充足するための実践に取り組みつつ、一方で自身の活動の意味を社会に提唱し、社会(具体的には政府、企業、個々の市民)から理解と資源(具体的には財政的支援やボランティアなど)を受け、それをもって自らの実践を社会化し活動の継続をはかる、という一連の機能を遂行しており、個々のNPOはそうした社会的な課題解決サイクルのいわば媒介者としてそれぞれの活動に取り組んでいるといえる。」\n　伊藤の分類を借りれば、現在のところ、一般に認知されやすいのは、NPO活動のうち第一と第二の面であり、特に社会サービスの供給主体としてのNPO活動に、社会の関心と期待が集まっているように見える。これは、経済低成長・超高齢化社会を迎えて福祉事業負担を軽減したいという行政の思惑にも合致している。\n　逆に第三と第四の面は、それほど重要視されているように見えない。特に第三のアドボカシー機能については、政治・行政の側に「市民運動＝反対運動」という硬直した図式に基づくアレルギー反応があるように見受けられる。NPO法が当初は「市民活動促進法案」(与党三党案)・「市民公益活動を行う団体に対する法人格の付与等に関する法律案」(新進党案)などとして提出されながら、国会(参議院)審議の段階で「市民」という名称が反発を受け、削除されたのは象徴的である。そしてNPOは、アドボカシーに成功しなければ、イノベーション機能を果たすことも覚束ない。\n　このような図式のなかで生成するNPOセクターは、安価な行政の下請けという機能を受け持つかわりに行政に保護され、その中でスポイルされてゆく、ひ弱で、歪んだものにならざるを得ないのではないか。NPOセクターの自立と成長を担保するためには、むしろ第三・第四の面にこそ注目し、その機能を充実させるという方向性をもった制度が不可欠ではないか。\n　本稿では、NPOのなかで実務を担当しておられる方々の協力を得て、現実のNPOがどのようなアドボカシーとイノベーションの機能を果たしているかを紹介したのち、今回制定されたNPO法がアドボカシーとイノベーションを含めたNPO活動の促進に資するものとなっているかどうかを検討してみたい。また、文教大学湘南図書館の地域貢献活動を例に、NPO活動がサービスの供給からイノベーションに至る道筋を探ってみたい。","subitem_description_type":"Abstract"}]},"item_5_description_38":{"attribute_name":"フォーマット","attribute_value_mlt":[{"subitem_description":"application/pdf","subitem_description_type":"Other"}]},"item_5_source_id_19":{"attribute_name":"ISSN","attribute_value_mlt":[{"subitem_source_identifier":"09173072"}]},"item_5_text_39":{"attribute_name":"本文言語","attribute_value_mlt":[{"subitem_text_value":"日本語"}]},"item_5_text_42":{"attribute_name":"ID","attribute_value_mlt":[{"subitem_text_value":"BKSK090204"}]},"item_5_text_7":{"attribute_name":"Author","attribute_value_mlt":[{"subitem_text_value":"Kanai, Erika"}]},"item_5_text_8":{"attribute_name":"所属機関","attribute_value_mlt":[{"subitem_text_value":"文教大学国際学部"}]},"item_5_text_9":{"attribute_name":"Institution","attribute_value_mlt":[{"subitem_text_value":"The Faculty of International Studies, Bunkyo University"}]},"item_5_version_type_35":{"attribute_name":"著者版フラグ","attribute_value_mlt":[{"subitem_version_type":"VoR"}]},"item_creator":{"attribute_name":"著者","attribute_type":"creator","attribute_value_mlt":[{"creatorNames":[{"creatorName":"金井, 恵里可"}],"nameIdentifiers":[{}]}]},"item_files":{"attribute_name":"ファイル情報","attribute_type":"file","attribute_value_mlt":[{"accessrole":"open_date","date":[{"dateType":"Available","dateValue":"2018-03-24"}],"displaytype":"detail","filename":"BKSK090204.pdf","filesize":[{"value":"3.6 MB"}],"format":"application/pdf","licensetype":"license_note","mimetype":"application/pdf","url":{"label":"BKSK090204.pdf","url":"https://bunkyo.repo.nii.ac.jp/record/3741/files/BKSK090204.pdf"},"version_id":"1a57e764-9c6b-40b9-bf46-917c43f10bd4"}]},"item_language":{"attribute_name":"言語","attribute_value_mlt":[{"subitem_language":"jpn"}]},"item_resource_type":{"attribute_name":"資源タイプ","attribute_value_mlt":[{"resourcetype":"departmental bulletin paper","resourceuri":"http://purl.org/coar/resource_type/c_6501"}]},"item_title":"NPOと公共性","item_titles":{"attribute_name":"タイトル","attribute_value_mlt":[{"subitem_title":"NPOと公共性"},{"subitem_title":"Nonprofit Sector and Public Welfare"}]},"item_type_id":"5","owner":"3","path":["214"],"pubdate":{"attribute_name":"公開日","attribute_value":"2011-02-24"},"publish_date":"2011-02-24","publish_status":"0","recid":"3741","relation_version_is_last":true,"title":["NPOと公共性"],"weko_creator_id":"3","weko_shared_id":-1},"updated":"2023-05-15T17:58:15.173917+00:00"}
