Usually these people are unskilled laborers. Their position in regards to human rights is lower than foreigners holding the legal residence status or Japanese. There are many cases where their human rights are infringed, because they are considered illegal aliens by the Immigration Control Act.\n　This paper refers to human rights of foreigners over staying their visas as unskilled laborers. First, I will discuss structural defects that cause their human rights to be infringed by the Immigration Control Act. Secondly, I will discuss problems about their human rights protection and the omission of regulations of human rights in Japan's domestic law system and its enforcement.
