| 内容記述 | The travel agents plan "the mountain climbing tour" that target old and middle age participants for sales. In 2004, the participants of domestic mountain climbing tours organized by travel agents exceeded 260,000. With the increased number of old and middle age mountaineers, domestic mountain accidents of our country have increased rapidly from 1994, and the percentage of old and middle age victims is 70～80 percent. In spite of the increase in the number of accidents in agent organized "mountain climbing tour", there are few court cases about mountain accidents, but there are some extremely particular accidentsthat have become a criminal cases. From these detective incidents, we took up the accident that occurred on "Mt.Yotei mountain climbing tour" of Hokkaido which K travel agent carried out in September, 1999 and we considered the liability of the travel agent. In March, 2004, the judge of Sapporo district court sentenced the tour conductor to two years' imprisonment with three years' suspension of sentence for professional negligence resulting in death. It seems that there are many problems with not only the tour conductor and the travel agent but also tour participants, but we appreciate that judgment. Because it seems that the criminal liability for this accident is caused by ability of the tour conductor and the system of the travel agent. In addition, some travel agents established "a travel agency tour mountain climbing conference"in 2003. And, in 2004, they devised "a tour mountain climbing service guideline" in order to keep safety in mountain climbing tours and maintain the natural environment. | |||||||||||
