| 内容記述 | The Inter-American Commission on Human Rights (IACHR) has two functions. One is the function as an organ of the OAS, and the other is one as an organ of American Convention on Human Rights (ACHR). They are promotional and contentious functions. Before the entry into force of ACHR, IACHR performed just a promotional function. In its promotional role, IACHR presides over thematic hearings, publishes thematic or country-specific human rights reports, and conducts on-site visits to regions with problematic human rights situations. Before ACHR, the major task of IACHR was to carry out on-site visits to evaluate the general human rights situation in member countries. However, the power of IACHR was expanded by the 1967 Protocol of Buenos Aires. IACHR began to accept the alleged human rights complaints or petition from individuals or groups as the information of general human rights situation in OAS member states. After the entry into force of ACHR, IACHR also got contentious function by ACHR. In this function, it accepts the alleged human rights complaints or petitions from individuals or groups in ACHR member states, and considers them in light of relevant human rights instruments and jurisprudence. It also considers claims for precautionary measures and helps to negotiate friendly settlements between the parties in contentious cases. I will examine how the activities of IACHR have changed and what effect they have produced to secure redress for human rights violations by expansion of the power of IACHR which now has double functions as an organ of OAS and ACHR. |
